1. Definitions

• "Velora", "we", "us", "our" — the yacht charter operator described above.
• "Guest", "you", "your" — the person making an enquiry or booking.
• "Charter" — a private yacht booking for a specified duration and itinerary.
• "Agreement" — the booking confirmation and these Terms and Conditions together.

2. Acceptance of Terms

By submitting a booking enquiry or confirming a charter, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are booking on behalf of a group, you accept these terms on behalf of all members of that group.

3. Service Description

Velora offers private yacht charters departing from Chalong Pier, Phuket. Three charter types are available: Half-Day Coastal Cruise, Full-Day Island Hopping Charter, and Multi-Day Voyage Package. Full descriptions, durations, and inclusions are detailed on the Solutions page of our website. Service availability is subject to vessel availability, weather conditions, and operational safety assessments.

4. Booking Process

All bookings begin with a written enquiry. We will respond with a charter proposal and, if agreed, provide a booking confirmation by email. A deposit is required to confirm your charter date. The booking is not confirmed until the deposit has been received and a confirmation email has been sent by Velora.

5. Payment Terms

A deposit of 30% of the total charter fee is required at the time of booking. The remaining balance is due on or before the day of departure. Accepted payment methods will be communicated in your booking confirmation. All prices are quoted in Thai Baht (฿). Prices include crew, fuel, and catering as described per charter type. Any additional services agreed in writing prior to the charter are invoiced separately.

6. Cancellation and Rescheduling

If you cancel a confirmed booking:

• More than 14 days before the departure date: full deposit refund
• 7–14 days before departure: 50% deposit retained
• Less than 7 days before departure: full deposit is non-refundable

Rescheduling to a new date (subject to availability) is permitted without penalty if requested more than 7 days before departure. Velora reserves the right to cancel or reschedule a charter due to unsafe weather, vessel mechanical issues, or force majeure. In such cases, we will offer a full rescheduling option or a full refund of amounts paid.

7. Weather and Safety

The skipper holds final authority over departure decisions. If sea conditions are assessed as unsafe, the charter may be delayed, rescheduled, or have its itinerary modified. This determination is at the skipper's sole discretion and is not grounds for a refund where the charter proceeds in an adjusted form. Guests are required to follow crew instructions at all times. Velora may refuse embarkation to any guest who appears to be under the influence of substances that pose a safety risk.

8. Guest Responsibilities

Guests are expected to:

• Arrive at Chalong Pier at the agreed departure time
• Treat the vessel, crew, and other guests with reasonable care and respect
• Follow all safety instructions provided during the pre-departure briefing
• Disclose any medical conditions relevant to sea travel prior to boarding
• Refrain from bringing prohibited items on board

Guests are liable for any damage to the vessel or equipment caused through negligence or deliberate action.

9. Intellectual Property

All content on the Velora website — including text, imagery, and design — is the property of Velora and may not be reproduced without written permission. Use of the website grants a limited, non-exclusive licence to view content for personal informational purposes only.

10. Disclaimers

Velora provides charter services in good faith and with reasonable professional care. We do not guarantee specific sea conditions, wildlife sightings, weather, or identical experiences to those described in marketing materials. The website content is provided for informational purposes. We are not responsible for inaccuracies resulting from conditions outside our control.

11. Limitation of Liability

To the extent permitted by applicable law, Velora's liability is limited to the total amount paid for the charter in question. We are not liable for indirect, consequential, or incidental losses arising from charter participation, including but not limited to travel disruptions, lost personal items, or itinerary changes due to weather. Nothing in these terms limits liability for personal injury caused by gross negligence.

12. Indemnification

You agree to indemnify Velora against any claims, costs, or damages arising from your breach of these terms, your conduct on board, or misrepresentation of your group's details during the booking process.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any disputes arising from this agreement shall be subject to the jurisdiction of the courts of Phuket Province, Thailand. We encourage parties to attempt informal resolution before initiating any formal proceedings.

14. Changes to Terms

We may update these Terms and Conditions periodically. The current version will always be published on this page with the effective date noted. Bookings made after the effective date of any update are subject to the revised terms.
